Qualifying Period for unfair dismissal claims to rise

The Government has announced its decision to extend the qualification period for the right to claim unfair dismissal from one year to two. The change will come into force on 1 April 2012.
The proposal was one of the reforms suggested in the ‘Resolving Workplace Disputes’ consultation, conducted earlier this year, which sought views on a variety of proposals aimed at removing barriers to business growth in order to ‘create the conditions which allow businesses to flourish and expand, by reducing regulation and maintaining a flexible and dynamic labour market’.
Included were measures to encourage early resolution of disputes, to speed up the Employment Tribunal (ET) process and to tackle weak and vexatious claims.
To this end, the Chancellor of the Exchequer, George Osborne, has also announced plans to introduce fees for bringing an ET claim with effect from April 2013. Successful claimants would have their fee refunded. The Ministry of Justice will shortly be publishing a consultation on the proposed fee levels.
